INTRODUCTION

In this Consent to Receive Information Electronically (“Consent”), the terms “you” and “your” refer individually and collectively to each person who submits an electronic application for Commonwealth Ordnance Finance Company, LLC financing issued by Sandbar Acquisition Company, LLC (the “Account”), through a website administered by its service Compass Technologies. The terms “we,” “us,” and “our” in this Consent refer individually and collectively to, Sandbar Acquisition Company, LLC, and Compass Technologies. This consent shall apply to all documents related to your Account.

HARDWARE & SOFTWARE REQUIREMENTS

To receive an electronic copy of any documents related to your Account, you must have or have access to a personal computer or other device that is capable of accessing the Internet and have software that permits you to receive and access Portable Document Format or “PDF” files, such as Adobe Acrobat Reader®

HOW TO WITHDRAW YOUR CONSENT

Except for the communications we provide to you electronically at the time of this Account application and those that disclose our decision about your Account application, you may withdraw your Consent to receive Account communications electronically at any time by writing to us at Sandbar Acquisition Company, LLC, 33 Bassett Lane, Suite 200, Hyannis, MA. 02601 or calling us at: (844) 223-2632. If you withdraw this Consent, we will continue providing application and Account services to you in nonelectron- ic form at no additional charge, except that we may require you to pay an annual fee to maintain your Account as described in your Retail Installment Contract. If you withdraw this Consent, you understand and agree that any prior Account and application communications provided or delivered to you in electronic form will remain legally effective, valid, and enforceable.

HOW TO UPDATE YOUR RECORDS

You agree to promptly update your e-mail address if a change occurs by calling Sandbar Acquisition Company, LLC at: (844) 223-2632 or writing us at to Sandbar Acquisition Company, LLC, 33 Bassett Lane, Suite 200, Hyannis, MA. 02601. You agree that the most recent email address we maintain for you is the one we may use to provide electronic communications.

PAPER COPY OF COMMUNICATIONS

To obtain a paper copy of any electronic communications, you may submit your request to us in writing at Sandbar Acquisition Company, LLC, 33 Bassett Lane, Suite 200, Hyannis, MA. 02601. There will be no charge for a paper copy of any material we send you.

APPLICATION AGREEMENT

Before we can process the information for your loan application, we must have your agreement on the following:



The information I provided is true and correct to the best of my knowledge.

  • I am a U.S. resident at least 18 years old.
  • I authorize Sandbar Acquisition Company, LLC and/or its designated agent, and/or other assigns to investigate my creditworthiness (including employment and salary information)
  • I understand and agree that Sandbar Acquisition Company, LLC and its service providers or assigns may obtain consumer reports about me in connection with this credit application and for purposes of updating, reviewing, servicing, and collecting any credit account I may receive as a result of this application.
  • I understand that, upon my request, I will be informed whether a consumer report was requested and provided with the name and address of any consumer reporting agency that furnished a consumer report.
  • I understand that any offer I receive will automatically expire 90 days after the application submit date if not approved and accepted within that period.


IMPORTANT INFORMATION ABOUT PROCEDURES FOR OPENING A NEW ACCOUNT

To help the government fight the funding of terrorism and money laundering activities, Federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you: When you open an account, we will ask for your name, address, date of birth and other information that will allow us to identify you. We may also ask to see your drivers license or other identifying documents. If you are married, you can still apply for a separate account in your own name. If you are married and reside in a community property state the assets of your marital community may be liable on this account even if you apply for an individual account and this application is not signed by your spouse (unless you mail a signed statement to Sandbar Acquisition Company, LLC, 33 Bassett Lane, Suite 200, Hyannis, MA. 02601 that you wish to apply for a separate account based solely on your separate assets).



STATE DISCLOSURES

NEW YORK RESIDENTS:
Residents may contact the New York State Banking Department at 800-518-8866 to obtain a comparative listing of credit card rates, fees and grace periods.

OHIO RESIDENTS:
The Ohio laws against discrimination require that all creditors make credit equally available to all credit worthy customers, and that credit reporting agencies maintain separate credit histories on each individual upon request. The Ohio civil rights commission administers compliance with this law.

WISCONSIN RESIDENTS:
No provision of a marital property agreement, a unilateral statement, or a court decree adversely affects the interest of the creditor, unless the creditor, prior to the time the credit is granted, is furnished a copy of the agreement, statement, or decree or has actual knowledge of the adverse provision when the obligation to the creditor is incurred. If I am a married Wisconsin resident and my spouse is not applying with me for a joint account, I agree to send the name and address of my spouse to Sandbar Acquisition Company, LLC, 33 Bassett Lane, Suite 200, Hyannis, MA. 02601 within 15 days after I submit my application, so that my spouse may receive account information required by Wisconsin law.

CONSUMER REPORTING AGENCIES

You understand and agree that you are authorizing Sandbar Acquisition Company, LLC to send your information to lenders on your behalf who may obtain consumer reports and related information about you from one or more consumer reporting agencies, such as Trans Union, Experian, and Equifax

EMPLOYMENT VERIFICATION

You understand and agree that you are authorizing Sandbar Acquisition Company, LLC to verify your employment in good standing. Electronic means may be used to verify employment. Personal contact to your department supervisor may also be used.

COLLECTION OF INFORMATION

We collect personally identifiable information, such as names, postal addresses, email addresses, etc., when voluntarily submitted by our visitors. The information you provide is used to fulfill your specific request. This information is only used to fulfill your specific request, unless you give us permission to use it in another manner, for example to add you to one of our mailing lists.

ACH Acknowledgment

Monthly payments will be withdrawn automatically on the designated due date for repayment. During the Retail Installment Contract signing process, Borrowers will complete an ACH enrollment form that includes the name of their financial institution along with checking account and routing numbers from which their monthly loan payments will be deducted.

If the borrower chooses not to take advantage of the ACH withdrawal method, they should contact Sandbar Acquisition Company Customer Service at (844) 223-2632.
